General Provisions

These Regulations set out the rules for using the CATEROCK.COM online store, in particular the conditions for concluding and terminating contracts (placing orders) and the complaint procedure.

Whenever these Regulations mention:

Seller – it ought to be understood as the website owner

Consumer – it ought to be understood as a user or a buyer who is a natural person who registers on the Website or purchases any products or services through the website for purposes not directly related to the business or professional activity of that person.

Website – it ought to be understood as a sales platform operated by the Seller.

§1 Determining the scope of activity

1. Service CATEROCK.COM allows placing orders 24 hours a day for a product customized by the Employer in the form of footwear sewn on individual orders. Detailed prices and shipping costs are always attached to a given product to be ordered. The delivery time for shoes from ordering and paying for it is around 14 to 21 business days.

§2 Technical requirements necessary to cooperate with the ICT system

1. The website allows you to order the offered goods using commonly available software in the form of web browsers that accept cookies, e.g. FireFox browser version 3 or newer, Opera version 9 or newer, Chrome version 10 or newer, Internet Explorer version 7 or newer Safari. Browsers must have the latest JAVA and FLASH versions installed. Website resolution is optimal in 1024px settings. All third-party software may affect the proper functioning of the store and should be turned off.

2. The Seller shall not be liable for technical problems or technical restrictions that occur in computer equipment or software used by the User to use the Website, and which prevent or hinder the User from using the Website.

§3 Conditions for concluding and terminating contracts, and for processing orders

1. The condition of using the store’s offer is to familiarize yourself with the rules of making purchases and the price list (prices in EURO) provided on the website, as well as all the provisions of these Regulations.

2. In order to order the product presented on the website, the User selects items for the basket or selects another available purchase path, in the form of an order placed by e-mail: shop@caterock.com

3. The contract is concluded when the User places the order.

4. The order is carried out immediately after the conclusion of the contract and payment of the order as it is a product carried out on order.

5. The user may choose the form of proof of purchase, in the form of an electronic invoice, paper, receipt, invoice – in this case he is required to indicate in the form the data necessary to issue the relevant document.

6. The purchased products are delivered by sending the carrier with the chosen option to the address provided in the order form.

7. In the event of a complaint, the Seller shall be liable within 2 years of delivery of the item being the subject of the purchase in the event of non-compliance of the product with the concluded contract, in accordance with § 4 of these Regulations.

8. The consumer cannot give up the goods bought on the CATEROCK.COM website without giving a reason within 14 days from the date of receipt of the parcel because these products are sewn on an individual order with features matching the specific customer, hence there is no possibility of return.

9. According to art. 38 of the Act on Consumer Rights, withdrawal from the contract does not apply to goods whose return for hygienic reasons is unacceptable and non-prefabricated goods, serving the individual needs of the Buyer.

§ 4 Complaint procedure

1. In the event of defects or non-compliance of the goods with the contract, the buyer has the right to complain about the goods by notifying the seller by e-mail to the following e-mail address: shop@caterock.com or by post to the following address: OUTDOOR S.C. 2. The complaint should contain the following data:

first name and last name
correspondence address (also email address and telephone number)
subject of the complaint
reason for complaint
signature (only in the case of a complaint submitted by post)

3. Complaints will be considered by the Seller immediately.

4. The Seller will inform the User about the result of the complaint to the email address indicated in the complaint, and in the case of correspondence by mail – to the address provided by the User.

5. If the complaint is accepted, the Seller undertakes to agree on the date and procedure for repairing the goods or replacing the goods free of defects – and if this is not possible – reducing the price.

6. If the defect of the item sold is significant, the consumer has the right to withdraw from the contract.

7. The User who is a consumer also has the option of using out-of-court complaint handling and redress in online shopping disputes by submitting a complaint via the EU ODR online platform, available at: http://ec.europa.eu/consumers/odr

§5 Processing and Protection of Personal Data

1. The Seller, being the administrator of personal data, protects Users’ personal data. The data provided by the User may be processed only for the purposes set out in the Regulations to carry out the order and the purposes set out in the Privacy Policy available at https://caterock.com/privacy-policy

§6 Final Provision

1. These Regulations apply from the date they are made available on the Website and constitute an integral part of the contract concluded with the User. The current version of the Regulations is available to the User in the Regulations tab: https://caterock.com/terms-and-condition

2. The Seller reserves the right to amend these Regulations. The registered User will be notified in electronic form about the content of changes to these Regulations 30 days before the changes come into force. Amendments to the regulations may not worsen the legal situation of consumers concluding contracts based on the previous version of the regulations.

3. All Purchases, the implementation of which began before the new Regulations entered into force, will be implemented in accordance with the previous version of the Regulations.

4. In matters not covered in these Regulations, the provisions of Polish law shall apply, in particular the provisions of the Civil Code (Dz.U. 1964 nr 16 poz. 93 ), act on the provision of electronic services (Dz.U. 2002 nr 144 poz. 1204), Consumer Rights Act (Dz.U. 2014 poz. 827), as well as the Act of 29 August 1997 on the protection of personal data (Dz.U. 1997 nr 133 poz. 883).
